This Domestic Associate Policy (hereinafter referred as the “Policy”) outlines the standards and procedures to be followed by all associates (hereinafter referred as the “Associate”) of Munjal Universal Consultancy LLP (hereinafter referred to as “LLP”) in the execution of their duties related to referring candidates/students seeking admission in higher education institutions overseas to the LLP. These standards encompass various aspects of the lead generation and recruitment process, including but not limited to candidate connection, screening, marketing and other related procedures (hereinafter referred to as “Recruitment Services”). By providing clear directives, the Policy aims to streamline roles and responsibilities, enhance efficiency, and maintain consistency in service delivery. Adherence to this Policy is crucial to upholding professionalism, ethical conduct, and compliance with applicable laws and regulations.
The Associates in providing Recruitment Services shall comply with all relevant local, state, and federal laws, rules and regulations including but not limited to equal opportunity laws, anti-discrimination laws, and data protection laws.
The LLP is committed to providing equal opportunities to all individuals regardless of race, caste, colour, religion, sex, national origin, age, disability, or any other protected status as defined under the applicable laws. Therefore, it is imperative that Associates diligently ensure that all Recruitment Services are conducted in a manner that reflects this commitment. This entails fostering an environment free from discrimination and bias, where every candidate is evaluated solely based on their qualifications, skills, and merits, without regard to any personal characteristics.
Associates shall ensure that all information obtained from clients, candidates, or any other source during the recruitment process must be treated with the utmost confidentiality. Associates must not disclose sensitive information that may include personal details, professional backgrounds, and proprietary business information to any unauthorised parties and are obligated to comply with data protection laws including but not limited to Information Technology Act, 2000 read with Information Technology (Sensitive Personal Data Information) Rules, 2011 and Digital Personal Data Protection Act, 2023 (as enforced) and any amendments thereto. The Associates must familiarize themselves with the requirements of the applicable laws and ensure that their actions align with the principles of data protection, including lawful processing, transparency, and accountability.
All Associates are expected to conduct themselves in a professional manner in provision of Recruitment Services. This includes respectful and courteous communication with clients, candidates, and colleagues, as well as maintaining a high standard of integrity and honesty. Associates shall not engage in any kind of discrimination, harassment (including sexual harassment), bullying, or any form of disrespectful or discourteous behaviour against clients, students, partners, and colleagues. Acts such as any illegal gratification, threats, coercion, intimidation, assaulting or using abusive, aggressive and vulgar language towards clients, partners, and colleagues goes against the ethics and values of the LLP and shall amount to a breach of this Policy.
The Associates will operate under a transparent commission structure that is communicated in advance, and all financial transactions will be handled in accordance with the LLP’s accounting procedures.
It is the duty of the Associates to ensure that all prospective candidates are accurately and transparently presented to the LLP. The Associates shall provide clear information about candidates’ qualifications, experience, any other pertinent attributes that align with the requirements of the universities and suitability for the destination, and refrain from any exaggeration or misrepresentation.
The Associates shall be committed to delivering high-quality Recruitment Services to candidates. This commitment extends to ensuring that candidates receive comprehensive support and guidance throughout the recruitment process. Continuous communication, feedback collection, and a commitment to meeting candidate’s expectations are essential aspects of ensuring client satisfaction.
The LLP will provide regular training opportunities to Associates to ensure they are up-to-date with industry best practices, legal requirements, and evolving recruitment trends. These training sessions are designed to equip Associates with the knowledge and skills necessary to excel in their roles, stay ahead of the curve in a rapidly evolving industry landscape, and uphold the highest standards of professionalism and compliance.
The Associates shall disclose to the LLP of any potential conflicts of interest, including financial arrangements with educational institutions or other entities that may influence counselling recommendations.
The Associate may be subject to performance metrics established by the LLP, including the quantity and quality of candidate referrals. The Associate shall provide regular reports to the LLP regarding candidate referrals, ensuring transparency and accountability in providing Recruitment Services.
This policy will be reviewed periodically to ensure its relevance and effectiveness. At the sole discretion of the LLP, the Policy can be modified including incorporating any necessary updates or revisions in response to changes in the regulatory environment or the LLP’s operations. Updates will be communicated to all Associates, and training may be provided as needed.
The Associates must enter into an Associate Agreement with the LLP, outlining their roles and responsibilities in delivering Recruitment Services. By adhering to this Domestic Associate Policy, all Associates contribute to the reputation and success of the LLP while promoting ethical and professional recruitment practices. Any breach or violation of this Policy will be subject to the terms outlined in the Associate Agreement, potentially leading to termination of the agreement and accountability for incurred losses.
